Dear Chairman Shuster: I am writing regarding section 7004 of the conference report to accompany H.R. 3080, the Water Resources Development Act of 2013. The provisions contained in section 7004 were in neither the House bill nor the Senate amendment. As you know, the provisions in that section constitute rules of the House of Representatives and Senate, respectively, and as such, fall within the jurisdiction of the Committee on Rules. Because of your willingness to actively consult with my committee regarding this matter, I do not object to the inclusion of these provisions in the conference report. By agreeing to the inclusion of the section, the Rules Committee does not waive its jurisdiction over those provisions now or in the future. In addition, the Committee on Rules expects that it would receive a referral on any measure or matter addressing these provisions in the future.
