The amendment is as follows: (Purpose: To amend the Energy Employees Occupational Illness Compensation Program Act of 2000 to expand the ways beryllium sensitivity can be established for purposes of compensation under that Act and to extend the authorization of the Advisory Board on Toxic Substances and Worker Health of the Department of Labor) At the appropriate place in title XXXI, insert the following: SEC. ___. AMENDMENTS TO THE ENERGY EMPLOYEES OCCUPATIONAL ILLNESS COMPENSATION PROGRAM ACT OF 2000. (a) Short Title.--This section may be cited as the ``Beryllium Testing Fairness Act''. (b) Modification of Demonstration of Beryllium Sensitivity.--Section 3621(8)(A) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7384l(8)(A)) is amended-- (1) by striking ``established by an abnormal'' and inserting the following: ``established by-- ``(i) an abnormal''; (2) by striking the period at the end and inserting ``; or''; and (3) by adding at the end the following: ``(ii) three borderline beryllium lymphocyte proliferation tests performed on blood cells over a period of 3 years.''.…
