Irrespective of one's opinion of the President's reliance on Article II authority to justify the TSP, those companies that assisted with the TSP did so in good faith and based upon the written-- I repeat: ``written representations''-- from the highest levels of government that the program was lawful. The Committee's bill reported out on a strong, bipartisan vote of 13-2-- I wish to repeat that. That is a strong vote. ... [That vote] reflects our determination that companies that cooperated with the government in good faith should be protected from time-consuming and expensive litigation. It is a matter of fundamental fairness.
