I would like to resolve one of the issues that I think is resolvable, on the Smith amendment. What the Senator is concerned about is he wanted a floor on the amount of damage, so that incidental damage by citizens who are engaged in peaceful or nonviolent demonstrations or protests would not trigger the antiterrorism language of this bill. I ask my colleague from Delaware if he would agree that a definition of ``terrorist'' in this legislation is not intended to apply to American citizens engaged in a nonviolent or peaceful demonstration, or demonstrations or protests where incidental damage to property may occur.
