In my opinion, absolutely not. It applies to other cases where a firearm is used, such as in a robbery. It doesn't apply to border agents who are required to use and possess a firearm while they are on duty. And so it is not, in my opinion, the intent of Congress. And, of course, that will be litigated on appeal as well.
