The Senator's position is this--if someone polluted your water so you can't drink it, and did so to the required degree of negligence and liability, they are responsible for it and should pay. The question is, What if you didn't do anything that justifies a lawsuit? What if you had no connection whatsoever? You made MTBE and somebody takes it and pollutes your house with it. Who is responsible? I can tell you what the law has been historically in America.
