The Constitution extends protections to persons within the United States. These people, again, whom we are at war with have never been afforded constitutional protections. And you are right, the Nazis captured in Long Island and in Florida were given due process in a military tribunal, as these individuals have been given due process in military tribunals at Guantanamo Bay.
