of course, they maintain discretion. Agencies will have full discretion if we adopt this language, the discretion to consider the effects over which that agency or the cooperating Federal agencies have jurisdiction. That is it. What we are saying is that we shouldn't have courts making stuff up, and we shouldn't have agencies making stuff up. That is all we are trying to say. Let's get everybody in their lanes. Let's get the agencies in their lanes, and then, let's allow the American people to do what they do best. Mr. Chair, I reserve the balance of my time.
