TREATMENT UNDER FREEDOM OF INFORMATION ACT OF CERTAIN SENSITIVE NATIONAL SECURITY INFORMATION. (a) Critical Infrastructure Security Information.-- (1) In general.--The Secretary of Defense may exempt certain Department of Defense information from disclosure under section 552 of title 5, United States Code, upon a written determination that-- (A) the information is Department of Defense critical infrastructure security information; and (B) the public interest in the disclosure of such information does not outweigh the Government's interest in withholding such information from the public. (2) Information provided to state or local first responders.--Critical infrastructure security information covered by a written determination under this subsection that is provided to a State or local government to assist first responders in the event that emergency assistance should be required shall be deemed to remain under the control of the Department of Defense.…
