Before accepting this proposition I have thought it right to take the advice of the Senate.
The practice of making such appointments, whether in a vacation or during the session of Congress, has been constantly followed during every Administration from the earliest period of the Government, and its perfect lawfulness has never to my knowledge been questioned or denied.
Had I refused to adopt this precautionary measure, and evil consequences, which many good men at the time apprehended, had followed, I should never have forgiven myself.
A demand for these purposes will be made in a firm but conciliatory spirit.
