first, again, I thank the Senator from Ohio for his excellent comments and particularly his latter focus on the legal issues that were not brought up earlier. I had not had the opportunity, and neither did anybody else, to focus attention on why this particular legislation is, in fact, constitutional and that should not be a reason to not vote for this legislation. An excellent job done.

The president certainly has the right. No one is arguing he has the right to nominate somebody.
The only reason this was a contentious issue is because there were two different parties and there are two different branches.
