The amendments made by this Act shall not apply with respect to an enterprise (as defined in section 3 of the Fair Labor Standards Act of 1938 (29 U.S.C. 203)) that-- (1) employs fewer than 10 individuals; or (2) whose annual gross volume of sales made or business done is less than $1,000,000.
