The text of the amendment is as follows: At the end of subpart 3 of part E of title V of the Elementary and Secondary Education Act of 1965, as proposed to be amended by section 501 of the bill, add the following new section: ``SEC. 5552. CRIMINAL BACKGROUND CHECKS. ``(a) Condition of Receipt of Funds.--A local educational agency or State educational agency shall be ineligible for funds under this Act if such agency-- ``(1) employs an individual who-- ``(A) refuses to consent to a criminal background check that includes-- ``(i) a search of the State criminal registry or repository in the State where the individual resides and each State where such individual previously resided; ``(ii) a search of State-based child abuse and neglect registries and databases in the State where the individual resides and each State where such individual previously resided; ``(iii) a search of the National Crime Information Center; ``(iv) a Federal Bureau of Investigation fingerprint check using the Integrated Automated Fingerprint Identification System; and ``(v) a search of the National Sex Offender Registry established under the Adam Walsh Child Protection and Safety Act of 2006 (42 U.S.C.…
