(b) Private Parties.--A State may permit any private party to carry out a nonhighway use described in subsection (a). (c) Revenues Generated by Nonhighway Uses.--A State may use any revenues generated by a nonhighway use described in subsection (a) to carry out any project (as defined in section 101 of title 23, United States Code).”
