As we continue to see record levels of migrant encounters under this administration, and our nondetained docket continues to grow exponentially, we must use every available tool to compel the Department to enforce the law. Striking the provision will give the Biden administration a free pass to continue releasing migrants into the country, a total disregard of the law.
