What does the fourth amendment say? It is illuminating to read the text which describes each and every American's constitutional right: The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath and affirmation, and particularly describing the place to be searched, and the persons or things to be seized. While the fifth amendment contains an explicit exclusionary rule in that 'No person * * * shall be compelled in any criminal case to be a witness against himself * * *' the fourth does not. The exclusionary rule is a mechanism created by the Supreme Court designed to enforce violations of the fourth amendment. This bill does not abolish the exclusionary rule, but rather improves it. This bill seeks to broaden the 'good faith exception' by applying it to warrantless searches.
