H.R. 3764 misreads the Constitution, overturns longstanding historical precedent, increases the bureaucracy and legislative burden on Indian tribes and politicizes the Federal Acknowledgment Process.

Generally, The American Legion is in agreement with many of the Commission's recommendations. However, the report contains, at its heart, a fundamental flaw which must be recognized and addressed.
