I yield myself the balance of the time. Mr. Chairman, it would serve a purpose if people actually read the amendment. The amendment says none of the funds made available may be used to detain an individual who has been approved for release or transfer to a foreign country. We hear from the gentleman from Florida, these people are there for a reason. Yes, when we arrest somebody, a murder is committed, a rape is committed, we arrest somebody. But then, the grand jury says, no, we're not going to indict this person; there's not enough evidence. Do we hold them in jail indefinitely, forever, even though there's no charge, even though the District Attorney says we made a mistake; it's somebody else; they didn't do it? No. Because maybe they'll commit a crime? That's antithetical to every notion of what the United States is about. These are 86 people who are not charged as terrorists, who we have no evidence are terrorists, and who have been judged by the military and the Joint Chiefs of Staff and the intelligence community to pose no threat to us. By what claim of right do we hold them in jail? The United States, at this point, is no better than a kidnapper if it holds in jail people whom it charges with no crime and judges safe for release. Approve the amendment. I yield back the balance of my time.
