If this was a pretty horrendous crime, but they did not quite feel that it should get the ultimate sentence, capital punishment, they would then only get a term of years as sentenced by the judge, and I do not think that makes a great deal of sense. I think the jury should have the option. They can and should make the choice. But to eliminate the middle choice will force juries, because they will not go for a capital sentence, quite frankly, if they do not feel it merits it. So, actually in effect it would reduce the sentence on those that have committed pretty serious acts.
