The Secretary should direct drug manufacturers to calculate AMPs for these drugs to allow States to collect rebates. In order to maintain pharmacy reimbursement at appropriate levels for these drugs, the Secretary should use the discretion that is provided under the Patient Protection and Accountable Care Act to calculate a Federal upper limit, FUL, at an amount that is at least 175 percent of the weighted average AMP for those covered outpatient drugs.
