last year the Supreme Court said that Federal courts have authority to consider petitions for a writ of habeas corpus. This would apply to prisoners at Guantanamo. People should not be imprisoned without having the ability to challenge the legality of that imprisonment. That is the history of our common law system and our Constitution as well.
