My colleague from Ohio is correct. The managers' amendment clarifies the role of the State when new information has become available. Specifically, the Administrator must consult with the State before an enforcement action can be taken. Additionally, the State's records must be consulted to determine whether the new information was known by the State as defined in the legislation.
