The Clerk read as follows: Ms. Kuster moves to recommit the bill H.R. 4795 to the Committee on Energy and Commerce with instructions to report the same back to the House forthwith, with the following amendment: At the end of section 3, add the following new subsections: (d) Protecting Children and Seniors From Exposure to Dangerous Air Pollutants.--Subsection (b) shall not apply with respect to the review and disposition of a preconstruction permit application if-- (1) the new or revised national ambient air quality standard protects children and seniors from exposure to dangerous air pollutants, including any air pollutant that causes cancer; and (2) the preconstruction permit application is for a source that is located within 5 miles of a school, day care facility, hospital, or nursing home. (e) Protecting Small Businesses and American Jobs.-- Subsection (b) shall not apply with respect to the review and disposition of a preconstruction permit application for a source if subjecting the source to the existing national ambient air quality standard would result in higher costs or job losses for small businesses that-- (1) are subject to the new or revised national ambient air quality standard; and (2) are located in the State or nonattainment area involved.
