I think the Senator misspoke himself. The Senator indicated in the arbitration panel one would be appointed by the plaintiff, one by the plaintiff's lawyer, and then one by the two. I am sure the Senator will acknowledge it is one by the defendant, one by the plaintiff, and the two of them determine the third member. Section 1413 provides how the arbitration panel will work. Obviously, the two sides at issue each pick one, and the two of them pick the third. That is the standard means of establishing an arbitration panel.
