the major point here that the opposition to this makes is the President has inherent authority. That has not been tested at the Supreme Court because once FISA was enacted, that was enacted to limit unbridled Presidential authority. I believe FISA is the only way that you can proceed; that the President must go to FISA if he is going to conduct these kind of foreign intelligence activities.
