Doubtless certain punishments were common and usual for certain offences; but I do not think it can be shown that the common law, the lex terrae, which the king was sworn to maintain, required any one specific punishment, or any precise amount of punishment, for any one specific offence.

In that case the trial is really a trial by the government, and not by the jury.
They are every day committing errors, which would be crimes, but for their ignorance of the law.
From the sale of that justice which every citizen has a right to demand, it was an easy transition to withhold or deny it.
And the right is practically established only when and because the government, no longer exists to call it in question.
