The Clerk read as follows: Ms. Maxine Waters of California moves to recommit the bill H.R. 6392 to the Committee on Financial Services with instructions to report the same back to the House forthwith with the following amendment: Page 4, line 17, strike the quotation mark and following semicolon and insert the following: ``(4) Certain companies with pending lawsuits or enforcement actions designated by operation of law.-- Notwithstanding any other provision of this subsection, a bank holding company shall be deemed to have been the subject of a final determination under paragraph (1) if the bank holding company, as of the date of enactment of this subsection-- ``(A) has total consolidated assets equal to or greater than $50,000,000,000; and ``(B) has disclosed in a filing with the Commission that a department or agency of the United States Government has a pending lawsuit or enforcement action against the bank holding company related to the origination, securitization, or sale of residential mortgage-backed securities.''.
