“The Brady Act did not intend, nor did it authorize the Department of Justice to charge a tax or fee to law abiding citizens to exercise their Second Amendment right. The National Instant Check System (NICS) is a national criminal justice program which was designed to quickly screen prospective firearms purchasers--weeding out prohibited gun purchases while ensuring that the sale of a firearm to a law-abiding citizen could go forth without significant delay. The NICS is a federal program of benefit to all citizens and therefore the cost should be and will be borne by the federal government in view of the absence of any enabling provision relating to assessment of a user fee to gun owners.”
