The Clerk read as follows: Mr. Kildee moves to recommit the bill H.R. 1119 to the Committee on Energy and Commerce with instructions to report the same back to the House forthwith, with the following amendment: At the end of section 2, add the following new subsection: (c) Limitation.--This Act does not apply with respect to any coal refuse electric utility steam generating unit associated with air pollution that-- (1) harms brain development or causes learning disabilities in infants or children; (2) increases the risk of cancer; (3) causes respiratory and cardiovascular illnesses and deaths, including cases of heart attacks, asthma attacks, and bronchitis; or (4) increases mercury deposition to lakes, rivers, streams, and other bodies of water, that are used as a source of public drinking water.
