The Snowe-Jeffords amendment is fully consistent with the view that the Furgatch decision and the FEC regulation may be a constitutional approach for detecting ads that pretend to discuss issues, but are really attacks on candidates. If that's where the Supreme Court ends up, I will be glad to see it, but it will be a separate approach from the Snowe-Jeffords amendment's treatment of broadcast ads that name candidates just before an election.
