Madam Chair, I understand Mr. Smith's position here, but the truth is that when he suggests that we're doing things that are interfering with ongoing court tests, there have been a series of votes here already about the health care law and guaranteed to have more coming in this institution. So I'm not going to spend a lot of time on that suggestion. But I rise today in support of the amendment. It addresses the deadline for filing patent term extension applications under the Hatch- Waxman Act. By adopting a clear standard, the amendment would provide the opportunity and certainty needed to allow innovators to conduct the time-consuming and expensive medical research necessary to bring new lifesaving drugs to market. The amendment clarifies the law in a manner that tracks the only court decision to have addressed this particular provision. It will ensure that all applications and all cases are treated the same. Because the amendment merely confirms existing law, it is budget-neutral. The amendment enjoys broad support on both sides of the aisle. I hope that all of my colleagues will join me in supporting it.
