Mr. Chair, I have an amendment at the desk. The CHAIR. The Clerk will designate the amendment. The text of the amendment is as follows: In section 132(c) of the Clean Air Act, as proposed to be added by section 3 of the bill, strike ``and'' at the end of paragraph (1), strike the period at the end of paragraph (2) and insert ``; and'', and add at the end the following paragraph: ``(3) the term `nuisance dust' does not include particulate matter containing arsenic or other heavy metals that are hazardous to human health.''. The CHAIR. Pursuant to House Resolution 487, the gentleman from Massachusetts (Mr. Markey) and a Member opposed each will control 5 minutes. The Chair recognizes the gentleman from Massachusetts.
