This amendment, the Delahunt-Boehlert amendment, makes clear that the levying of taxes is not an appropriate judicial function. It leaves it to State and local governments to decide how to fund a judicial remedy to some illegal or wrongful action that they themselves are responsible for. It may involve spending cuts. It may involve borrowing. It may even involve raising taxes. But it is the State or local government's decision, not the court's decision, how to fund that particular remedy. That is what this amendment is all about.
