I am rising in opposition to the amendment, but I want to engage the gentleman from Louisiana [Mr. Tauzin] in a discussion because I think he overstated what the bill will look like if his amendment is adopted, and understated its effect. Hr said, ``I believe that if something is prohibited by State law, it would not be compensable.'' But that is what the underlying bill says. His amendment would restrict that. His amendment would say that if it is restricted as a nuisance under State law, it would not be compensable but anything else restricted by State law would be compensable.
