The procurement code reads, in article I section 3: ``Where entities, in the context of procurement covered under this Agreement, require enterprises not included in Appendix 1 to award contracts in accordance with particular requirements, Article III shall apply . * * *'' So the procurement code in itself deals with Government agencies and then, in article I, section 3, says, and I repeat: ``Where entities, in the context of procurement * * * require enterprises not included in Appendix 1 to award contracts in accordance with particular requirements, Article III shall apply. * * *'' ... this provision violates the procurement code.
