Before a vote on the floor on a Committee recommendation to proceed with an impeachment resolution, or upon the Committee's failure so to recommend after a reasonable time, any Member of the House should be entitled personally to review all executive-session material. Otherwise, that member would be required to decide on the impeachment question, whether yea or nay, without having all the information the Independent Counsel deemed relevant to send to the House. Today's rule, strictly construed, might not permit that access if the Judiciary Committee votes not to permit such access. However, this rule will expire in its effect at the end of this session, and no one anticipates a vote on the impeachment question before we must pass a new rule to govern our proceedings in the next Congress. Until we are called upon to make a vote on that fundamental question, I have no problem with the Judiciary Committee's exercise of discretion in deciding what material, out of concern for innocent third parties, should be held in executive session.
