Obviously, the law sets forth criteria that are to be employed. I don't have those in front of me. I will accept the contention of the Senator from Nevada that those are the criteria. The question is whether a prejudgment as to the outcome is already ordained. In my judgment, the positions that were already in process in 1994, prior to the implementation of the moratorium, suggest that those decisions 5 years ago had already essentially resulted in a preliminary decision to increase the standards by 15 to 35 percent. If, in effect, the moratorium does not go forward, I believe we would, indeed, be moving a process that will mandate this kind of increase.
