The fact is it was a sham compromise to try to get themselves out of a pickle because the nominees, the overwhelming majority of those nominees would be picked by the President, recommended by the Department of Education, so in fact it is the same body. It looks different but if it walks like a duck, talks like a duck and swims like a duck, it is a duck.
