“I have an amendment at the desk. The Acting CHAIR. The Clerk will designate the amendment. The text of the amendment is as follows: At the appropriate place in title X, add the following: SEC. 10__. REQUIREMENT FOR MEMORANDUM OF UNDERSTANDING REGARDING TRANSFER OF DETAINEES. Section 1034(b) of the National Defense Authorization Act for Fiscal Year 2016 (Public Law 114-92; 129 Stat. 969; 10 U.S.C. 801 note) is amended-- (1) by striking ``and'' at the end of paragraph (3); (2) by striking the period and inserting ``; and'' at the end of paragraph (4); and (3) by adding at the end the following new paragraph: ``(5) the United States Government and the government of the foreign country have entered into a written memorandum of understanding regarding the transfer of the individual and such memorandum of understanding has previously been transmitted to the appropriate committees of Congress.''.
