I wanted to comment on this particular legislation. Mr. President, I, like most Members, if not all Members, have been back at home discussing at official forums, school meetings, and with teachers, educators, parents, and students the impact of the current statute relative to education for children with disabilities. Clearly, there have been problems. There have been discipline problems, as the Senator from Washington has enunciated. There have been problems of excess regulations and paperwork for teachers. There have been accountability problems for schools. There have been funding problems due to the Federal Government not living up to its promise to fund up to 40 percent of the cost of this particular education. Now, there have been numerous attempts over the years since this was first introduced--in 1975, I believe--numerous attempts to modify and correct some of these problem areas. Most of those have not succeeded and many of the situations that have been enumerated by the Senator from Washington have continued. By the same token, there has been nowhere near consensus in this body to revoke that statute. I think there is a solid commitment to provide educational opportunities for students with disabilities.
