Mr. President, I would like to raise the point of order that section 1538 of the conference report to accompany H.R. 4348 violates rule XXVIII as it is a matter not committed by either House. This is not a partisan issue. The Senator from Illinois, Mr. Durbin, the Senator from Ohio, Mr. Brown, the Senator from Illinois, Mr. Kirk, and I reached an agreement on how to deal with this issue. Yet during this conference work that was proceeding in the dark of the night---- The PRESIDING OFFICER. The point of order is not debatable.
