To my friend from West Virginia, my response is that it does not. My amendment keeps that door to EPA alternative regulation closed and locked. The language the gentleman cites merely references law that is already on the books, as you heard in the general debate. Section 4010(c) of RCRA was enacted years ago to protect human health and the environment. My amendment merely clarifies that your bill does not change that. Mr. McKINLEY. Madam Chairman, the 4010(c) of RCRA also gives EPA authority to take into account the practicable capabilities of such facilities. Does the gentleman's amendment alter that authority in any way?
