H.R. 2221 from the last Congress and the Republican discussion draft of the SAFE Data Act require notice to the FTC and consumers of an electronic data breach only if the covered person has determined that the breach, quote, "presents a reasonable risk of identity theft, fraud or other unlawful conduct."
