I have just made a suggestion to the gentleman from California [Mr. Berman], and he seemed favorably disposed. The problem is the date certain. It encourages gridlock if you have to wait for a certain date. Let us remove the date and just say that in the pendency of a complaint, if the chairman and the ranking member together agree that a disposition is unlikely, then they shall dismiss without prejudice the pending claim. That leaves it up to you to decide, and you do not have that incentive to deadlock.
