Have you said the memoranda we are seeking in order to understand the jurisprudential philosophy of this nominee has not been produced except in those instances where it has been leaked or other instances where we have questions related to ethical considerations? And is the Senator not aware of the fact that I am holding in my hand a memorandum from Frank Easterbrook to the Solicitor General relative to the Bork nomination, produced for the Senate Judiciary Committee, relating not to an ethical case but rather to a civil rights case, and that it is in a category that the Senator from Utah has said, categorically, this evening, has never been produced; namely, a recommendation for an amicus brief participation? Is the Senator from Utah aware that the very brief and memorandum which he said has never been produced was, in fact, produced to the Senate Judiciary Committee during the Bork nomination? And I hold a copy in my hand.
