The amendment is as follows: (Purpose: To ensure that the storage and transportation of petroleum coke is regulated in a manner that ensures the protection of public and ecological health) At the appropriate place, insert the following: SEC. ___. REGULATION OF TRANSPORTATION AND STORAGE OF PETROLEUM COKE. This Act shall not take effect prior to the date that-- (1) the Administrator of the Environmental Protection Agency, in consultation with the Secretary of Transportation, promulgates rules concerning the storage and transportation of petroleum coke that ensure the protection of public and ecological health; and (2) petroleum coke is no longer exempt from regulation under section 101(14) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9601(14)), which may be established either by an Act of Congress or any regulations, rules, or guidance issued by the Administrator of the Environmental Protection Agency.
