So that there was absolutely no question about the FDA's authority in this area, during the debate on DSHEA we made clear that the FDA maintained its ability to act against false and misleading claims under section 343(a)(1) of the Federal Food, Drug and Cosmetic Act. This is the third important tool FDA maintains to assure consumers that they are taking safe and accurately labeled dietary supplement products. I worked very hard to make certain that we provided the FDA with adequate authority in this area, but that we did not open up the opportunity for the agency to twist and torture the law as they had done in years past.
