Mr. Chairman, as the designee of the gentleman from Rhode Island (Mr. Cicilline), I have an amendment at the desk. The Acting CHAIR. The Clerk will designate the amendment. The text of the amendment is as follows: Page 3, line 11, insert after ``extent necessary'' the following ``, and except as otherwise provided in this section''. Page 4, line 3, insert after the period at the end the following: SEC. 3. EXCEPTED RULES. Section 706 of title 5, United States Code, as amended by this Act, is further amended by adding at the end the following: ``(c) In the case of a rule made by the Commissioner of Food and Drugs of the Food and Drug Administration that pertains to consumer safety, to the extent necessary to decision and when presented, the reviewing court shall decide all relevant questions of law, interpret constitutional and statutory provisions, and determine the meaning or applicability of the terms of an agency action.''.
