Page 4, line 3, insert after the period at the end the following: SEC. 3. EXCEPTED RULES. Section 706 of title 5, United States Code, as amended by this Act, is further amended by adding at the end the following: ``(c) In the case of a rule made by the Secretary of Homeland Security pertaining to any matter of national security, to the extent necessary to decision and when presented, the reviewing court shall decide all relevant questions of law, interpret constitutional and statutory provisions, and determine the meaning or applicability of the terms of an agency action.''.
