Mr. Chairman, I rise as the designee of Congressman Conyers on this amendment. The Acting CHAIR. The Clerk will designate the amendment. The text of the amendment is as follows: Page 3, line 18, strike ``or (d)'' and insert the following: ``(d), or (e)''. Page 5, insert after line 7 the following: (e) Exception for Regulatory Actions Pertaining to Privacy.--An agency may take a significant regulatory action if the significant regulatory action pertains to privacy. Page 10, insert after line 13 the following and redesignate provisions accordingly: (c) Privacy Exception.--Section 202 shall not apply to a midnight rule if the midnight rule pertains to privacy. Page 19, insert after line 25 the following: (d) Exception.--This section shall not apply in the case of any consent decree or settlement agreement in an action to compel agency action pertaining to privacy. The Acting CHAIR. Pursuant to House Resolution 738, the gentleman from Georgia (Mr. Johnson) and a Member opposed each will control 5 minutes. The Chair recognizes the gentleman from Georgia.
